According to the news paper reports Punjab & Haryana High Court has put the court put the Department of Atomic Energy, Nuclear Power Corporation and Union Ministry of Environment and Forest on notice seeking their reply on the contentions raised on the project. The HC has also issued a notice to the Atomic energy regulatory board of India as well as the Haryana government and asked them to respond by February 2. Citing various apex court judgments against the acquisition of fertile land, the villagers pleaded that the government should quash the project since the proposed site is extremely fertile land where annually at least 2 major crops are taken by farmers.
While as a tactic it is important to make use of every possible avenue of struggles including the Indian courts, it is very important to note that the final decision on all such major issues depends only on relentless struggle of the people. I have no doubt that the people of Gorakhpur will only use this respite to further intensify their struggle.
